Explore available properties

Kinshasa is the capital of DR Congo, and property here falls under Congolese law, not West African rules. On Imonga, the city's page mainly lists new-build projects for now: towers and apartment buildings in Gombe, residences in Ngaliema and Limete, and a development at Bibwa in the Nsele commune. Rental and resale listings appear in the list as they are published. The text below covers two things to check before signing: what Congolese law says about residential leases, and which document proves a right to land. It also flags the reforms adopted in 2025 and 2026.

What Imonga lists in Kinshasa

The page mostly gathers new-build project listings, each published under its developer's name. They include apartment buildings, residential towers and mixed-use projects in Gombe (The Grand Residence Kinshasa, IMMOROSE), residences in Ngaliema (IMMOROSE), apartments in Limete, a residential tower in the Golf area (EGO Development) and a residential project at Bibwa, in the Nsele commune. Most are marked as under construction. A project under construction is not a finished home: the schedule, the price and what will actually be delivered are the developer's commitments, and each one should be confirmed in writing.

Renting: the 2015 law and the pending reform

Residential leases are governed by Law No. 15/025 of 31 December 2015 on non-professional leases. Article 18, as quoted by Actualite.cd (22 April 2023), caps the rental deposit at three months' rent for a residential lease. The same report says tenants complain that the rule is poorly enforced.

  • Insist on a written lease that separates the deposit (refundable at the end) from rent paid in advance.
  • Get a dated receipt for every payment, whether to the landlord or to a go-between.
  • Do a written move-in inspection, backed by photos.

A reform is under way. In early June 2026, the National Assembly passed a bill amending the 2015 law, Radio Okapi reported (6 June 2026). It provides for rent set and paid in Congolese francs, a lease permit, a digital national lease register, signing of leases before housing services, accreditation of estate agencies and a new system for handling deposits. It then went to the Senate. As of 30 October 2026, we found no source confirming a Senate vote or promulgation. Ask a lawyer which text applies before you sign.

Buying: the registration certificate is the proof

In DR Congo, the land itself belongs to the State (Article 53 of Law No. 73-021 of 20 July 1973, as amended in 1980). So a buyer does not buy the soil: they acquire a concession right over a plot. Under that law:

  • a right to use land is legally established only by a certificat d'enregistrement (Article 219);
  • a sale transfers the property only through a new certificate in the buyer's name (Article 220);
  • no encumbrance binds the property unless it is entered on the certificate (Article 220), and a mortgage exists only once registered (Article 264);
  • the sale must be made in authentic form (Article 231), after which the registrar of land titles (conservateur des titres immobiliers) records the transfer and issues the new certificate (Article 236).

In practice, pay nothing on the strength of a private sale agreement or a customary chief's paper alone. Have the land titles office confirm that the certificate exists, is in the seller's name and carries no encumbrance.

The 1973 law was amended by Law No. 25/62 of 3 December 2025, promulgated on 31 December 2025 according to Actualite.cd (1 January 2026). It provides for a fully digitised cadastre, the abolition of acquisitive prescription over land and an official land price scale. The article numbers above are from the 1973 text as amended in 1980: have a notary or lawyer confirm the procedure in force on the day of the sale.

Off-plan projects and intermediaries

For a new-build project, ask for the registration certificate of the plot, the developer's legal identity, a written contract describing what will be delivered and a payment schedule. Before paying any agent or go-between, check their mandate in writing and make every payment against a receipt.

FAQ: real estate in Kinshasa

Which document proves a right to land in Kinshasa?

The registration certificate (certificat d'enregistrement). Under Article 219 of Law No. 73-021 of 20 July 1973, a right to use land is legally established only by that certificate. The land itself belongs to the State (Article 53), so what you acquire is a concession. A private agreement or a customary document is no substitute: have the land titles office verify the certificate before any payment.

How much deposit can a landlord ask for?

Under Article 18 of Law No. 15/025 of 31 December 2015, as quoted by Actualite.cd in April 2023, the deposit cannot exceed three months' rent for a residential lease. A reform passed by the National Assembly in June 2026 provides for a new deposit system. We found no confirmation that it has been promulgated, so ask a lawyer which rule applies.

Must rent be paid in Congolese francs?

Not with certainty yet. In early June 2026, the National Assembly passed a bill requiring rent to be set and paid in Congolese francs, Radio Okapi reported. The bill then went to the Senate. As of 30 October 2026, we found no source confirming a Senate vote or promulgation. Check with a lawyer before signing a lease.

Do I need a notary to buy property in Kinshasa?

The 1973 law requires a sale to be made in authentic form before the transfer can be recorded (Article 231). The law also lets the registrar of land titles draw up the deed himself, after checking the parties' identity and capacity. The registrar then issues the new certificate (Article 236). A notary or lawyer can tell you which route to take and what it costs.

What did the 2025 land reform change?

Law No. 25/62 of 3 December 2025 amends the 1973 land law. It was promulgated on 31 December 2025, according to Actualite.cd. Among other things, it provides for a fully digitised cadastre, the abolition of acquisitive prescription over land and an official land price scale. Have a notary or lawyer confirm the procedure in force when you buy.
