1. Purpose
These terms govern the use of the imonga platform (imonga.com), published and operated by Modalko inc. (NEQ 1182607458, 206-25 Vincent-D'Indy Avenue, Montreal, Quebec H2V 2S8, Canada), which lets users publish, browse and manage real estate listings for sale and rent and real estate developments. In these terms, "imonga", "we" and "our" mean Modalko inc.
2. Access to the service
Browsing listings is free and open. Posting listings requires creating an account. Users agree to provide accurate information when registering.
3. User account
Users are responsible for keeping their credentials confidential and for all activity on their account. They can also sign in with Google or Facebook; that service then vouches for the account's email address. imonga offers, among others, "individual", "real estate agent" and "developer" accounts.
4. Posting listings
Advertisers warrant that they are entitled to list the property offered and that the information provided is accurate, up to date and not misleading. Imonga may remove any non-compliant listing.
5. Real photos and listing review
A listing describes one property, at its actual price. Photos must be real photos of that property, taken on site. The following are not accepted as photos of the property: images generated or altered by artificial intelligence, posters and promotional visuals (with slogans, prices or contact details overlaid), photos of another property, and the image of an official document (land title, stamp) presented as proof. An official document is attached to the listing as a private supporting document: only our team opens it, it is never shown to visitors, and the advertiser can withdraw it at any time, which deletes the file. The “Document seen by imonga” mention only means that a member of our team has seen the document presented: it is neither a check of its authenticity nor a guarantee of ownership. Computer-generated views of a development yet to be built (architect's views) belong on a development page, not in a listing. The only exception is a unit that a developer publishes from the unit table of their development page. Its listing reuses the development's images and carries the “New, off-plan” mention; its price, area and availability are those the developer keeps up to date in that table, under their responsibility. A listing may also be attached by its author to a development the property belongs to: it is then shown separately from the developer's units, and the developer may ask for it to be removed from that page. Every listing is reviewed, automatically and then by our team: an image that is not a photo of the property is not shown to visitors, and a listing with no real photo of the property is not put online until a real photo is added; it then goes online by itself. Likewise, a listing that presents several properties, a general offer (price range, several locations) or something other than a property for sale or for rent is not put online until it describes a single property; the advertiser can have it split into one listing per property. The displayed price is the price of the whole property, as the buyer or tenant will pay it: a listing with no price, with a plainly impossible price, or whose displayed price contradicts the one in its description is not put online until the price is corrected. The advertiser is informed at once, by email and in their account, and may correct the listing or contest the review by replying to the message received: a member of our team then looks at the images again.
6. Published content
Advertisers keep ownership of the texts and photos they publish. For as long as they are published, they grant imonga the free, non-exclusive right to display, reproduce and adapt them (format, translation) on the platform and its distribution channels, for the sole purpose of promoting their listings.
7. Liability
imonga acts as a host of listings and is not a party to transactions between users. The platform does not guarantee the accuracy of listings published by users. Before any commitment, check the title deed and the property, and seek professional advice.
8. Suspension and closure of accounts
imonga may suspend or close an account that breaches these terms, publishes misleading listings or harms other users; the user is informed and can contest the decision by replying to the message received. Users can close their account at any time, as described in the Privacy Policy.
9. Personal data
The processing of personal data is described in the Privacy Policy. Users have the right to access, rectify and delete their data.
10. Changes to these terms
imonga may change these terms. Users are informed of any substantial change by email or on the website before it takes effect. The version in force is the one published on this page.
11. Governing law and disputes
These terms are governed by the laws applicable in Quebec. They do not deprive consumers of the protection granted by the mandatory rules of their country of residence. In case of a dispute, first write to [email protected] to seek an amicable solution. Failing that, the dispute is brought before the courts of the judicial district of Montreal, without prejudice to the consumer's right to sue in the courts of their place of residence.
