In Kumasi, in Ghana's Ashanti Region, a land deal is rarely just a matter between a seller and a buyer. Part of the land is stool land, held by a customary stool in trust for its community: what you get is a lease, never a freehold. Local chiefs, the Asantehene's Lands Secretariat and the Lands Commission each step in at a different stage. For rentals, Ghanaian law limits how much rent a landlord may ask for in advance. As of 10 October 2026, no property listing is published on Imonga for Kumasi: this page presents the new developments listed there, then sets out what to check before you sign.

Renting in Kumasi: advance rent is limited by law
In Ghana, a landlord may not demand or collect more than six months' rent in advance for a long-term tenancy. Under the Rent Act, 1963 (Act 220) this is a criminal offence, punishable by a fine or up to two years in prison, as the acting Rent Control Commissioner, Frederick Opoku, said at a press conference in Accra reported by the Daily Graphic on 24 June 2026. The rule is national, so it applies in Kumasi as it does in Accra. He also asked tenants to gather evidence and report higher demands to the Rent Control Department.
Before you pay, ask for a written tenancy agreement and a receipt for every payment. No public schedule sets rents and, as of 10 October 2026, no listing is shown on Imonga for Kumasi: compare several offers once listings are published there.
Buying land: a lease, not a freehold
Nobody, Ghanaian or not, can obtain a freehold in stool land. The 1992 Constitution, articles 266 and 267, sets three rules: stool land vests in the stool, which holds it in trust for its subjects; no freehold interest can be created in it; and a non-citizen cannot be granted a lease of more than fifty years at any one time. It adds that stool land cannot be disposed of or developed unless the Regional Lands Commission certifies that this fits the approved development plan.
The Land Act, 2020 (Act 1036) builds on these principles. According to the summary by the law firm Bentsi-Enchill, Letsa and Ankomah (26 April 2022), the Lands Commission will not register an instrument that grants a freehold in stool or family land, and a company more than 40% owned by non-Ghanaians counts as non-Ghanaian for the fifty-year limit.
In Kumasi this is visible on the ground. At the end of 2021 the State returned 409.24 acres of the Ridge Residential Area to the Asantehene on behalf of the Golden Stool, between the Bekwai road, the Santasi Roundabout and the Danyame Stream. Leaseholders there become tenants of the Asantehene and pay annual ground rent to the Golden Stool, The Fourth Estate reported on 30 May 2022.
Who does what in Kumasi
| Who | Role | Source |
|---|---|---|
| Caretaker chief | Allocates the plot and issues the allocation note | K. O. Mireku, 2012 |
| Asantehene's Lands Secretariat, Manhyia Palace | Checks the documents before the lease is prepared | K. O. Mireku, 2012 |
| Lands Commission, Ashanti regional office (Mess 4th Garden, Danyame) | Land searches for a fee, registration of title and deeds | Lands Commission, RTI Manual 2026 |
The first two rows follow the sequence described in 2012 by a valuation surveyor who had worked at the Lands Commission in Kumasi: negotiation, allocation note and site plan, search at the Lands Commission, submission to the Asantehene's Lands Secretariat, lease, then registration. Practice may have changed since, so confirm it locally. The manual we read does not publish search or registration fees: ask at the counter.
What to watch for in Kumasi
- Double sales and expired leases. On 28 February 2023 the Ghanaian Times reported that the Asantehene had warned Kumasi chiefs against selling one plot to two buyers and against forcibly retaking land once a lease had expired, at hearings held on 20 February (chief of Bantama) and 23 February (chief of Amakom). Check how many years remain on the seller's lease.
- Registration. On 2 July 2025 the Ministry of Lands announced plans to expand land title registration beyond Greater Kumasi (ministry statement). Ask the Lands Commission which regime covers your plot.
- Spouses and land guards. In Ghana, the Land Act requires a spouse's written consent to dispose of property acquired during the marriage, and punishes the use of land guards with 5 to 15 years in prison, according to the same legal summary.
Have a lawyer licensed in Ghana review any document before you pay. Legal fees are negotiated: ask for a written quote. None of this carries across borders: Imonga's guide to land status in Togo shows how different a neighbouring system can be.
New developments listed
As of 10 October 2026, two new developments are listed for Kumasi on Imonga. Prabon Greenfields is a gated community now selling, which the project's own website places at Prabon, No. 3 Asanteman Avenue, with houses and serviced plots. Locus Place II is an apartment complex under construction, attributed to the developer Locus Estate. Buying off-plan does not change the land checks above: the lease, its remaining term and its registration still need to be verified.

FAQ: real estate in Kumasi
Can a foreigner buy land in Kumasi?
A foreigner can obtain a lease, not a freehold. Article 266 of Ghana's 1992 Constitution bars creating a freehold for a non-citizen and limits a non-citizen's lease to fifty years at any one time. On stool land, article 267 rules out freehold for everyone. Have a lawyer licensed in Ghana check the term and the lessor before any payment.
How many months of advance rent can a landlord ask for in Kumasi?
For a long-term tenancy, no more than six months: this is the rule in Ghana's Rent Act, 1963 (Act 220), restated by the Rent Control Department at a press conference in Accra reported by the Daily Graphic on 24 June 2026. Going beyond it is a criminal offence. The rule is national, so it applies in Kumasi. Keep evidence of any higher demand and report it to the Rent Control Department.
Where can I check that a plot in Kumasi is not already registered to someone else?
At the Lands Commission's Ashanti regional office at Danyame (Mess 4th Garden), Kumasi. The Commission's 2026 manual states that land searches are available at all its divisions for a fee. The amount is not published there, so ask at the counter. Run the search before paying anything, and bring the site plan of the plot.
Is an allocation note enough to own land in Kumasi?
In the sequence described in 2012 by a former Lands Commission officer in Kumasi, the allocation note issued by the chief is only a first step. It is followed by a search at the Lands Commission, checks by the Asantehene's Lands Secretariat, preparation of the lease and its registration. Ask a Ghanaian lawyer what your document is worth at that stage.
What is the main risk to rule out before buying land in Kumasi?
Double sales. In February 2023, according to the Ghanaian Times, the Asantehene publicly rebuked Kumasi chiefs for selling the same plot to two buyers and for forcibly retaking land once a lease had expired. Check who is entitled to allocate the plot, how many years remain on the lease and what is registered at the Lands Commission.
