To rent an apartment in Yamoussoukro, start from online listings, visit before paying anything, and insist on a written lease. In Côte d'Ivoire, residential leases are governed by Law No. 2019-576 of 26 June 2019 establishing the Construction and Housing Code (Code de la construction et de l'habitat). The Code bars landlords from demanding more than two months of advance rent and caps the security deposit at two months of rent. The lease must also be registered with the tax administration. The rent itself is negotiated with the landlord, so compare several listings before you commit.

Where to look and how to sort listings

Start online, then check everything in person. The Yamoussoukro property listings page shows what is published on Imonga in the city. The number of listings changes from week to week, so check the page itself rather than relying on an old count. If you are weighing Yamoussoukro against other Ivorian cities, compare with listings in Abidjan, Bouaké or Korhogo.

  • Know who you are dealing with: the owner, an agency or an informal broker (démarcheur). Get a full name and a working phone number.
  • Insist on a real visit: photos prove neither that the unit exists nor that it is vacant.
  • Get what is included in writing: individual or shared water and power meters, security guard, number of rooms.

Using an agency is optional. Article 419 of the Construction and Housing Code states: « Le recours à une agence immobilière, en vue de la conclusion d'un contrat de bail à usage d'habitation, est facultatif » (using a real estate agency to conclude a residential lease is optional). It adds that working as an agency or broker « est soumis à agrément ou à autorisation » (requires a licence or authorisation). Ask any agency for its licence. None of the sources consulted sets agency or broker fees, so get the amount in writing before the visit.

What Ivorian law says about residential leases

The key rules fit in ten lines. They apply in Yamoussoukro as in the rest of the country. The quotations below are from the Construction and Housing Code, with an English rendering.

TopicWhat the Code saysArticle
Form« Le contrat de bail à usage d'habitation est écrit » (the residential lease is in writing)414
TermIt may be for a fixed or an indefinite term414
RegistrationThe lease « fait obligatoirement l'objet d'enregistrement auprès de l'administration fiscale » (must be registered with the tax administration). The landlord or their representative gives the tenant a copy of the registration deed within thirty calendar days.414
Advance rent« Le bailleur ne peut exiger le paiement de plus de deux mois de loyers d'avance au candidat à la location » (the landlord may not demand more than two months of advance rent)415
Security deposit (caution)It « ne peut excéder deux mois de loyer » (may not exceed two months of rent) and is refunded within one month of the keys being returned416
Inventory (état des lieux)Where there is a deposit, a written inventory, agreed and signed by both parties, is signed no later than move-in day and on the last day of the tenancy416
PaymentRent is paid monthly on a date set in the lease422
Rent reviewRent may be revised up or down every three years. The party seeking a change notifies the other at least three months before it takes effect.423 and 424
Landlord taking the unit backThe landlord must give the tenant notice at least three months before the date of repossession440
Tenant leavingTermination is possible after three months' written notice to the landlord for a legitimate reason442

Take a hypothetical rent of 100,000 FCFA. The landlord can ask for at most 200,000 FCFA in advance rent plus 200,000 FCFA as a deposit, so 400,000 FCFA on entry. Agency and registration costs may come on top. Above that cap, Article 415 says any advance rent beyond what the law allows « doit faire l'objet d'une déclaration à l'Administration fiscale » (must be declared to the tax administration) and, according to the Côte d'Ivoire public service portal, « La violation de cette disposition constitue une infraction pénale sanctionnée d'une amende de 200.000 F.CFA » (breaching it is a criminal offence punishable by a fine of 200,000 FCFA).

The law is not always followed. In February 2022, Connectionivoirienne reported that some Ivorian landlords asked for 6 or even 12 months paid in advance. The Construction Ministry said it acts only on complaints: « Il faut les dénoncer avec preuves à l'appui » (they must be reported with supporting evidence). The article gave the ministry's toll-free number, 1378, free only from a landline. Keep every receipt.

In January 2021 the ministry released a standard lease contract, according to Fraternité Matin. It then cost 10,000 FCFA per pair of copies and was sold in post offices, bookshops, licensed real estate agencies and the Guichet unique de l'habitat (housing one-stop desk). The price and sales points date from 2021, so confirm them locally.

Checks before you sign and pay

  1. Visit with a checklist. Test the taps, sockets, windows and drainage, and look at the ceiling.
  2. Check who is renting. Ask for the landlord's ID. If someone else is acting for them, ask for a written mandate. Never pay someone who cannot show they have the right to rent the unit.
  3. Read the lease. It should state the rent, payment date, term, advance and deposit. Compare those amounts with the caps in Articles 415 and 416.
  4. Sign the inventory. Attach dated photos. This is your evidence for getting the deposit back.
  5. Pay against a receipt. Prefer a traceable payment (bank transfer or mobile money). If you pay cash, get a signed receipt.
  6. Ask for the registration copy within the thirty days set by Article 414.

Frequently asked questions

How much do I pay when moving into an apartment in Yamoussoukro?

The Construction and Housing Code caps advance rent at two months (Article 415) and the deposit at two months of rent (Article 416), caps also reported by Fraternité Matin. For a 100,000 FCFA rent, that is at most 400,000 FCFA, plus any agency and registration costs. Have each amount written into the lease and keep the receipts.

The landlord wants six months up front. What can I do?

That is above the two-month legal cap. According to the Côte d'Ivoire public service portal, a breach is a criminal offence (« infraction pénale ») punishable by a fine of 200,000 FCFA. The Construction Ministry says it acts on complaints backed by evidence, so collect the listing, messages and receipts before reporting the landlord. Looking for another unit is often faster than a formal complaint.

Is a verbal agreement enough?

No. Article 414 says the residential lease is in writing and must be registered with the tax administration. Without a written lease, it is hard to prove the agreed rent, what you paid and the state of the unit. The ministry's standard contract, sold since 2021, gives you a compliant template. For your specific situation, have a notary or lawyer confirm this point.

When do I get my deposit back?

Under Article 416, the deposit is refunded within one month of the keys being returned. The written inventory, signed by both parties at move-in and on the last day of the tenancy, is the basis for comparing the unit's condition. Without it, deductions are hard to dispute.

Can the landlord raise the rent every year?

No. Article 423 allows rent to be revised up or down every three years. The party wanting a change must notify the other at least three months before it takes effect (Article 424). An increase announced without that notice can be challenged. In a dispute, a notary or lawyer can review your lease.

What is the average rent for an apartment in Yamoussoukro?

None of the official sources consulted publishes an average rent for Yamoussoukro. The most reliable approach is to compare recent listings for similar units (number of rooms, neighbourhood, meters). Check the listings published on Imonga for the city, then negotiate on that basis.

These are the rules in Côte d'Ivoire. They differ in other West African countries.
